Terms of Service

These Terms of Service ("Terms") govern your use of H-AI-LEY™ — Human-AI Learning Engine for You — operated by HRB Studios™ ("HRB Studios," "H-AI-LEY," "we," "us," or "our").
By creating an account, purchasing a subscription, or using H-AI-LEY, you agree to these Terms and our Privacy Policy.
1. About H-AI-LEY
H-AI-LEY is an educational AI tutoring and study platform.
Depending on the features you use, H-AI-LEY may help you:
- Understand academic concepts
- Work through homework and assignments
- Organize semesters, courses, assignments, and deadlines
- Review syllabus information
- Create and study flashcards
- Take practice quizzes
- Track learning activity
- Receive study recommendations
- Maintain course and assignment context across tutoring sessions
H-AI-LEY is designed to support learning. It does not guarantee grades, admission, academic performance, professional qualifications, or any particular educational outcome.
2. Eligibility and age requirements
The public edition of H-AI-LEY is intended for users 13 years of age and older.
Users under 13 may not create or use a public H-AI-LEY account.
COPPA generally applies to online services directed to children under 13, and to general-audience services with actual knowledge that they are collecting personal information from a child under 13.
Users ages 13–17
Users ages 13–17 may use H-AI-LEY subject to the additional privacy and safety protections described in our Privacy Policy.
A user ages 13–17 who purchases a Solo subscription must confirm that they have permission from a parent or legal guardian before beginning the paid subscription.
Parent-linked child accounts do not purchase subscriptions independently. Billing for those accounts must be handled through the applicable parent account.
Parent plans
You must be 18 years of age or older to purchase or manage a Parent Plan.
If you create or manage an account for another person, you represent that you have authority to do so.
3. Accounts and security
You agree to provide accurate information when creating and maintaining your account.
You are responsible for:
- Maintaining the confidentiality of your login credentials
- Using a valid email address
- Keeping account information reasonably current
- Taking reasonable steps to prevent unauthorized access to your account
You may not share an account in a way that bypasses subscription limits, account controls, safety protections, or other restrictions.
If you believe your account has been compromised, change your credentials and contact us promptly.
4. Educational use and AI limitations
H-AI-LEY uses artificial intelligence to generate tutoring responses and other educational material.
AI systems can:
- Make mistakes
- Misunderstand questions
- Produce incomplete information
- Provide outdated information
- Generate information that sounds confident but is incorrect
H-AI-LEY should therefore be used as a learning tool rather than as an infallible source.
You should verify important information using instructors, textbooks, course materials, qualified professionals, or other trusted sources when appropriate.
5. Academic integrity
H-AI-LEY may be used to help understand and work through coursework, including homework, projects, essays, and graded assignments when outside assistance is permitted.
H-AI-LEY does not assume that an assignment is prohibited simply because it is graded.
You may not knowingly use H-AI-LEY to obtain assistance that your school, instructor, testing organization, or applicable rules expressly prohibit.
Examples include:
- Requesting direct answers during a closed-book or proctored exam where outside assistance is prohibited
- Using H-AI-LEY on an assessment after being told that AI assistance is not allowed
- Fabricating research sources, experimental results, attendance, participation, citations, or other academic records
- Misrepresenting work in a way that violates applicable academic-integrity rules
When H-AI-LEY knows that direct assistance is prohibited for an active assessment, it may instead explain the underlying concept, demonstrate a similar example, or help you study the relevant method.
You remain responsible for following the rules established by your school, instructor, testing organization, or educational institution.
6. Professional and emergency information
H-AI-LEY is an educational service and is not a replacement for licensed professional services.
H-AI-LEY does not provide professional medical, legal, financial, mental-health, or other licensed professional advice.
H-AI-LEY is also not an emergency or crisis-response service.
For important health, legal, financial, safety, or other professional decisions, consult an appropriately qualified professional or trusted source.
7. Your content
You may submit content to H-AI-LEY, including:
- Questions and prompts
- Homework or assignment text
- Essays and other writing
- Syllabus documents
- Images
- Audio
- Other educational material
As between you and HRB Studios, we do not claim ownership of content merely because you submit it to H-AI-LEY.
You retain whatever rights you already hold in your submitted content.
You grant HRB Studios a limited license to host, process, reproduce, transmit, display, and otherwise handle that content as reasonably necessary to:
- Provide the requested H-AI-LEY features
- Store account-scoped educational information
- Maintain academic continuity
- Secure the Service
- Enforce safety and account rules
- Diagnose technical problems
- Comply with applicable legal obligations
H-AI-LEY does not use private user submissions to train a generalized HRB Studios AI model.
Third-party material
You are responsible for ensuring that you have the right or permission to upload and use content you submit.
This may include copyrighted textbooks, school materials, images, documents, or other material owned by someone else.
HRB Studios does not independently verify ownership or licensing of every uploaded file.
8. AI-generated content and shared educational images
H-AI-LEY may generate educational content such as explanations, study materials, flashcards, quizzes, text, and images.
HRB Studios does not promise that AI-generated outputs are exclusive to you.
Shared educational image library
H-AI-LEY maintains a reusable educational image library.
Certain AI-generated educational images may automatically be saved by subject and age category and reused when appropriate for other learners.
This shared-library behavior applies to AI-generated educational images.
Private syllabus uploads, ordinary vision/image uploads, prompts, and other private user submissions are not automatically placed into that shared educational image library.
Your use of AI-generated content remains subject to applicable law and any relevant third-party provider terms.
9. H-AI-LEY intellectual property
H-AI-LEY and its associated:
- Name and branding
- Logos
- Website and application design
- Software
- Source code
- Original interface components
- Proprietary systems and materials
are owned by HRB Studios or its applicable licensors.
You may not copy, sell, sublicense, reverse engineer, impersonate, commercially exploit, or present H-AI-LEY as your own except where applicable law expressly permits otherwise.
10. Acceptable use
You may not use H-AI-LEY to:
- Violate applicable law
- Harass, threaten, stalk, or abuse another person
- Attempt to compromise another user's account
- Circumvent subscription limits or access controls
- Intentionally bypass security or safety systems
- Attempt unauthorized access to H-AI-LEY infrastructure
- Distribute malicious software
- Fraudulently obtain paid access
- Use the Service in connection with prohibited academic misconduct described above
We may restrict functionality or suspend access when reasonably necessary to protect users, HRB Studios, or the Service.
11. Free trial
Eligible verified accounts may receive a limited free tutoring trial.
The currently advertised trial provides 20 tutor messages unless otherwise stated at signup.
Trial availability, features, and limits may change for future users.
Changing a future trial offer does not retroactively convert an existing paid subscription into a free plan.
No credit card is required for the currently advertised 20-message free trial.
12. Paid subscriptions and automatic renewal
H-AI-LEY currently offers monthly paid subscription plans, including Solo and Parent plans.
Before a paid subscription is created, H-AI-LEY displays the applicable monthly price and automatic-renewal terms and requires affirmative acceptance of the subscription terms.
Paid monthly subscriptions automatically renew each month until canceled.
The amount, plan, and billing frequency presented at checkout are part of your subscription agreement.
Payments are processed through Stripe.
HRB Studios does not store your complete payment-card number on its own servers.
Canceling a subscription
You may manage and cancel an eligible Stripe-backed subscription through:
Account → Manage billing / cancel
For ordinary subscription cancellation through the billing portal:
- Cancellation is scheduled for the end of the current paid billing period
- You retain paid access through that billing period
- Stripe stops future renewal after that period ends
California requires businesses offering online auto-renewing subscriptions to provide an online cancellation method and obtain express affirmative consent to the renewal terms.
Deleting your account
Deleting your H-AI-LEY account is different from ordinary subscription cancellation.
If you delete your account while a linked subscription is active:
- H-AI-LEY cancels the linked subscription as part of the deletion process
- Account access ends as part of the deletion
- Account-linked data is handled according to our Privacy Policy
Because the account itself is being removed, account deletion does not preserve H-AI-LEY access through the remainder of the billing period.
Account deletion does not automatically create a prorated refund.

13. Failed payments and subscription status
If a payment fails, is reversed, disputed, or otherwise cannot be completed, we may restrict paid features or update the account's subscription entitlement.
Stripe may attempt payment collection according to its billing systems and applicable configuration.
Access to paid features depends on the subscription status recognized by H-AI-LEY.
14. Refunds
Refunds are governed by our separate Refund Policy, which is incorporated into these Terms.
Cancellation of a subscription generally prevents future renewal but does not automatically refund charges already paid.
Nothing in these Terms limits any refund or cancellation right that applicable law requires us to provide.
15. Third-party services
H-AI-LEY relies on third-party services for certain functionality.
These currently include:
OpenAI
OpenAI provides AI functionality used for features such as tutoring, vision, speech-to-text, image generation, and certain related AI features.
Stripe
Stripe processes subscription payments and provides billing/customer-portal functionality.
Third-party services operate under their own terms, security systems, and privacy practices.

16. Suspension and termination
We may suspend, restrict, or terminate access when we reasonably believe:
- These Terms have been seriously or repeatedly violated
- An account is being used fraudulently
- An account has been compromised
- Continued access presents a security or safety risk
- We are required to act by law or legal process
- Technical conditions require temporary restriction
You may stop using H-AI-LEY at any time.
You may also use the account-deletion controls described in our Privacy Policy.
Suspension or termination does not eliminate payment obligations that were validly incurred before termination, subject to applicable law and the Refund Policy.
17. Service availability and changes
We may modify, update, add, remove, suspend, or discontinue H-AI-LEY features from time to time.
We do not guarantee that every feature will always be available or operate without interruption.
We may also establish reasonable usage limits to protect service reliability, prevent abuse, or implement fair-use requirements.
18. Disclaimer of warranties
To the fullest extent permitted by applicable law, H-AI-LEY is provided "as is" and "as available."
We do not warrant that:
- The Service will always be available
- The Service will be error-free
- AI-generated information will always be accurate
- Every feature will work on every device
- Use of H-AI-LEY will produce a particular grade, academic result, or outcome
Some jurisdictions do not allow certain warranty exclusions, so some exclusions may not apply to you.
19. Limitation of liability
To the fullest extent permitted by applicable law, HRB Studios and its owners, operators, employees, contractors, and service providers will not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of or inability to use H-AI-LEY.
To the extent liability cannot legally be excluded, HRB Studios' aggregate liability relating to the Service will not exceed the amount you paid to HRB Studios for H-AI-LEY during the three months immediately preceding the event giving rise to the claim.
These limitations apply only to the extent permitted by applicable law.
20. Changes to these Terms
We may update these Terms as H-AI-LEY changes or as legal, technical, or operational requirements evolve.
When material changes are made, we will update the Last updated date.
Where appropriate, we may provide additional notice through the Service, email, or another reasonable method.
If a change requires additional consent under applicable law, we will request that consent.
21. Governing law
These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles, except where applicable law requires otherwise.
Nothing in these Terms removes rights that cannot lawfully be waived under applicable consumer-protection law.
